VIP Website in a Week

1. SERVICE DESCRIPTION & DELIVERABLES

1.1 VIP Website in a Week Service
The Service includes:
- Prep Work: Kick-off call, handpicked premium Shopify theme (up to AU$400 value), Google Drive asset upload, complete onboarding documentation
- Core Deliverables: 7 pages total (Homepage, About, FAQs, Contact, Checkout, Product Listing Page, Product Detail Page) using selected premium Shopify theme with client branding
- Design Approach: Website built using premium Shopify themes with native blocks and client branding - NOT custom design from scratch
- Optimization: Mobile + tablet optimization, basic SEO foundations
- Support: 7 days post-launch email support, custom video tutorials

1.2 Design Limitations
IMPORTANT: Client acknowledges that this service utilizes premium Shopify themes customized with their branding, NOT fully custom design from scratch. All design work is performed within the constraints and capabilities of the selected theme's native blocks and features.

1.3 Rush Service Option
Expedited delivery (3-4 business days) available for additional $500 + GST, subject to availability and current workload.

2. REVISION POLICY

2.1 Included Revisions
- Up to 3 rounds of feedback/revisions during the project week
- Revision rounds are subject to time availability within the 5-7 business day timeline
- Each revision round must be completed within 24 hours of request to maintain project timeline

2.2 Revision Scope
Revisions include:
- Colour adjustments within theme capabilities
- Text/copy changes
- Image replacements
- Layout adjustments within theme constraints

2.3 Excessive Revision Policy
- Revisions beyond the included rounds will incur additional fees of $150 + GST / hour
- Delayed client responses (>24 hours) may impact other clients' scheduled project start dates
- If client delays cause scheduling conflicts, Kida Digital reserves the right to reschedule the project with 48 hours notice

3. PAYMENT TERMS

3.1 Payment Schedule
- Deposit: $200 + GST (secures booking and covers onboarding materials)
- Second Payment: 50% of remaining balance due 2 days before project start date
- Final Payment: Final 50% due on last day of website week, prior to ownership transfer

3.2 Late Payment Policy
- Late payments will result in immediate project suspension
- Projects will not resume until payment is received in full
- Late payments may result in rescheduling to next available slot
- A 5% late fee applies to payments overdue by more than 48 hours

3.3 Project Pause Fee
If client delays exceed 5 business days due to non-responsiveness or incomplete materials, a $200 + GST project pause fee applies to resume work.

3.4 Ongoing Platform, Hosting and App Fees
Kida Digital will obtain permission from the client prior to utilising an app where ongoing costs are affiliated to the Client.
The client maintains all responsibilities for payment to platform hosting, ongoing app fees, and any external tools utilised for the express functionality of the website in question.
Kida Digital will not be held responsible for the performance of the website where fees are not paid by the client to the platform for hosting, apps and any other third-party tools utilised during development.
Any support or repair measures requested by the Client to Kida Digital will be quoted at an hourly rate of $150 + GST.

4. PROJECT TIMELINE & DEPENDENCIES

4.1 Standard Timeline
- VIP Website: 5-7 business days
- Brand Refresh Bundle: Additional 3 days

4.2 Client Dependencies & File Requirements
Project timeline depends on:
- Timely completion of onboarding materials
- Prompt response to revision requests (within 24 hours)
- Provision of all required assets in specified formats:
  - Images: High-resolution (minimum 1200px wide), JPG/PNG format
  - Logo: Vector format (AI, EPS, SVG) or high-res PNG with transparent background
  - Copy: Provided in Word document or Google Doc format
- Timely payment according to schedule

4.3 Delays & Force Majeure
Kida Digital is not liable for delays caused by:
- Client non-responsiveness or late asset provision
- Illness or medical emergencies (alternative arrangements will be made where possible)
- Technical issues with third-party platforms (Shopify, payment processors)
- Significant Shopify platform updates affecting functionality during project period
- Natural disasters or circumstances beyond reasonable control
- Time zone differences affecting communication (Client acknowledges Kida Digital operates in AEDT)
- High-traffic seasonal periods (Black Friday, Christmas) - advance booking recommended

4.4 Backup Plans
In case of illness or emergency, Kida Digital will:
- Notify client within 24 hours
- Provide revised timeline or reschedule options
- Maintain project continuity where possible

5. SCOPE LIMITATIONS

5.1 Included Features
Service is limited to deliverables explicitly listed in Section 1.1. Additional features require separate quotation and timeline adjustment.

5.2 Add-On Features
The following require additional time and fees and must be discussed during the initial project call:

- Email Marketing setup
- Custom Filters
- Live Chat integration
- Google Shopping setup
- Upsells/Cross-sells
- Advanced discount systems
- Mega Menu creation
- Product bundles
- Review systems
- Automations
- Blog setup
- Invoicing systems
- Copywriting services
- Subscription functionality
- Technical SEO beyond basics
- Related products setup

Important Add-On Policy:
- No set pricing - all add-on features are quoted individually based on complexity and time required
- Add-on features must be discussed and agreed upon during the initial project call
- Features not discussed in the initial call cannot be added mid-project
- Any additional features requested after project commencement will be quoted as a separate post-website week project at $150 + GST /hour for development time required
- Add-on features may extend the standard 5-7 day timeline and will be quoted with revised delivery dates

6. CLIENT RESPONSIBILITIES

6.1 Pre-Project Kickoff Checklist
Before project commencement, client must complete:
- ✅ Onboarding questionnaire (100% complete)
- ✅ All brand assets provided in correct formats
- ✅ Website copy finalized and approved
- ✅ Product information and high-quality images ready
- ✅ Second payment completed

6.2 Post-Launch Responsibilities
- Setting up ongoing Shopify hosting plan
- Website maintenance after 7-day support period
- Content updates and modifications
- Ongoing SEO and marketing efforts

7. INTELLECTUAL PROPERTY & OWNERSHIP

7.1 Theme Licensing
- Premium Shopify theme license transfers to client upon final payment
- Client receives full ownership of customized website
- Kida Digital retains right to showcase work in portfolio and marketing materials, online and physically.
- Kida Digital retains the right to utilise a prepaid version of any theme file from an external supplier outside of the Shopify Theme Marketplace.

7.2 Testimonials & Case Studies
Client agrees to provide testimonial upon project completion and consents to Kida Digital using project as case study for marketing purposes (with option to remain anonymous).

7.3 Third-Party Assets
- Client responsible for ensuring all provided content is legally owned or licensed
- Client indemnifies Kida Digital against copyright claims

8. LIABILITY & WARRANTIES

8.1 Service Warranty
- 7 days post-launch technical support for bugs or technical issues
- No warranty on third-party integrations or Shopify platform changes
- No guarantee of specific sales results or conversion rates

8.2 Platform Changes
If Shopify implements significant platform changes during project period that affect functionality, Kida Digital will work with client to find suitable alternatives within project scope or provide partial refund if resolution impossible.

8.3 Limitation of Liability
Kida Digital's liability is limited to the total project fee paid. Not liable for:
- Lost profits or business opportunities
- Third-party platform issues
- Client's failure to maintain website post-launch
- Changes to Shopify platform affecting functionality

9. TERMINATION & CANCELLATION

9.1 Client Cancellation
- Cancellation before project start: 50% refund of total fees paid
- Cancellation after project start: No refund, client receives work completed to date
- Deposit ($200) is non-refundable in all circumstances

9.2 Kida Digital Termination
Right to terminate for:
- Non-payment
- Abusive or unprofessional behavior
- Failure to provide required materials
- Requests outside agreed scope

10. COMMUNICATION & SUPPORT

10.1 Business Hours
- Monday-Friday, 9am-5pm AEDT
- Response time: Within 24 hours during business days
- Emergency support not included

10.2 Post-Launch Support
- 7 days email support for technical issues only
- Custom video tutorials provided
- Additional support available at $150 + GST/hour

10.3 Ongoing Maintenance
Website maintenance packages available separately - inquire for details.

11. WHAT HAPPENS NEXT?

After final payment:
1. Website ownership transfers to client
2. 7-day support period begins
3. Custom video tutorials delivered
4. Optional maintenance package discussion
5. Testimonial request (helps us help other businesses like yours!)

12. GENERAL TERMS

12.1 Governing Law
These terms are governed by Australian law and subject to Australian jurisdiction.

12.2 Modifications
Terms may only be modified in writing and signed by both parties.

12.3 Entire Agreement
This agreement supersedes all prior negotiations and constitutes the entire agreement between parties.
